Think the gearcase is locked up

The washer wont fill continuse to drain out the back. Ive tried to manualy move the tub/agitator but will not budge the motor isnt locked up so would it be that the gearcase is defect

How high is the drain hose compared to the top of the washer?

If you put the washer in the spin cycle will it spin?
